SANTO DOMINGO. The Anti-Money Laundering Unit of the Attorney General of the Republic and the District Attorney of San Pedro de Macoris wrote up the charges against the former Major League baseball player, Jose Rijo, the fugitive businessman Matias Avelino Javier (Daniel), his daughter and another five persons, for their alleged participation in the kidnapping and murder of the reporter Jose Silvestre, as well as for money laundering.

Besides the famous former pitcher Jose Antonio Rijo Abreu, his alleged partner Avelino Javier, who is also known by the names of Joaquin Espinal Almeyda and Milton Martinez Rodriguez, the charges also include his daughter Raysa Danelis Avelino Javier, Ángel Amed Mañón Gutiérrez, Elvin Canario D'Oleo (Haina), Fermín Marcelino Calderón, Denny Junior Serrano (Junior Presión), and Franklin Lugo Mejía (La Máquina).

The legal action was started before the Court of Instruction of San Pedro de Macoris by the director of the Anti-Money Laundering Unit, German Miranda Villalona, the deputy prosecutors of the court assigned to this unit, Maria del Carmen de Leon, Dulce Maria Luciano and the District Attorney for San Pedro de Macoris, Ingrid Pamela Rijo Caraballo.

The case makes note of the fact that Avelino Castro is a fugitive from both Dominican and Puerto Rican justice. He is alleged to have obtained several identities from Puerto Rico up to his entry into this country, obtaining here identity documents that are not his true identity. He is also said to be involved in drug trafficking, murder for hire and for laundering money from drug trafficking.

The case file adds that in order to carry out their criminal activities in the DR, "Daniel" as he is known by alleged associates in the network, used the services of Rijo and the other defendants.

With regard to the charges, the case says that the defendants allegedly carried out murders for hire, and who in this specific case carried out persecution, followed and kidnapped the reporter Jose Silvestre and later they killed him.

The authorities argue that all of this carried out as assignments led by Avelino Castro, who within his illicit activities held the position of the leader of the Cartel of the East, which was dedicated to carrying out all of the drug trafficking operations in the East.

The case file explains that when he found out that his name was published in the magazine called "La Voz de la Verdad" (The Voice of Truth), as it said that someone called Daniel, a.k.a. "El Cañon de Samana" (The Samana Cannon) was the alleged partner in drug trafficking activities of Alfredo Rodriguez, a.k.a. Niño Pata Corta (Kid Short Leg), who ordered the murder of Ramon Herrera (Momon), since he supposedly has kept some US$800,000 that Rodriguez had sent him as the proceeds from the sale of a load of drugs. Avelino Castro decided to communicate with the defendant Marcelino Calderon, who is a good friend and who has ties with him in drug trafficking activities, and he instructs him to take care of and lead the plan to kill Silvestre.

"Nino Pata Corta," who is said to be an alleged partner of the Puerto Rican capo Jose David Figueroa Agosto and of Ramon del Rosario Puente (Toño Leña), was killed in March 2010. Regarding Jose Rijo, the case files stressed the fact that his real participation consisted in planning, organization and structuring of the murder together with Avelino Castro.

They indicate that he presumably associated with him in several commercial activities in which Avelino Castro used the fake identity of Joaquin Espinal Almeyda.

This association consisted in assets and goods that were the property of Avelino Castro, under the fake name of Joaquin Espinal Almeyda, and these were put into his name, with the idea of hiding the real ownership and the illicit origin of the goods acquired by the fugitive. The case alleges that Rijo possessed, had, used and administered assets that were the property of Avelino Castro, acquired with money coming from his illegal activities, so that is why he is accused of money laundering.

First attempt

The accusation says that on 30 July 2011, the reporter Jose Silvestre saved his life because he was not in the province of La Romana, but this was not sufficient to stop the criminal plan against him, and in effect, on Monday, 1 August, this group allegedly had put into motion the execution of the criminal plan.
