Moves will continue against tender of coal-fired generators

The lawyer says the alleged letter from the Chinese businessman not authorizing an accusation lacks judicial standing

The legal representative of the companies Gezhouba Group Company Ltd and the Consortium IMPE, Angel Moreta, said yesterday that they will continue their judicial actions in the courts in order to achieve the restructuring of the tender process for the construction of the Thermoelectric Generator at Punta Catalina, which is composed of two coal-fired plants, which he says was corrupt.

He said that the Dominican Corporation of State - owned Electricity Enterprises (CDEEE) has tried to pu forward the idea of a conspiracy against the construction of the generating plants, when in reality they are dealing with a legal process caused by an unjustified disqualification.

"We are warning that if the official of the CDEEE (Rubén Bichara) insists that the sentence of the Superior Administrative Tribunal (which orders the suspension of the tender process) is without value, we are going to take the corresponding path against him, as a person. We will go to the ordinary penal jurisdiction," he noted. They will charge him with contempt of the laws and of the Constitution of the Republic.

The lawyers spelled out that the economic offer presented in the tender by the companies Gezhouba Group Company Limited and the Consortium IMPE was for US $900 million, much more economical than that presented by Odebrecht,S.A. (the company which was awarded the project) for US $2,040,000,000. He indicated that the CDEEE Limited itself to alleging substantial breaches in the base of the offer, without at any time establishing what they were.

Likewise, Moreta, during a press conference, presented a certification by the Ministry of Foreign Relations which confirms that in the ministry no communication from the Chinese businessman Zhang Wei, of the Gezhouba Group Company Limited, indicating that he does not authorize the presentation of the accusations, has been registered. The letter supposedly had been sent to the Office of Commercial Development of the Peoples Republic of China in this country.
