Judge to decide today on validity of titles in Bay of Eagles case
SD. The judge of the Eighth Courtroom of the Land Tribunal of the Original Jurisdiction of the National District, Alba Beard Marcos, is getting ready to issue today her sentence which will decide whether to proceed or not with the annulment of the property deeds issued on thousands of square meters of land in the Bay of Eagles (Bahia de la Aguilas) to private individuals.

The magistrate debated for six days in May the issues of a case regarding property rights registered in the area, which is part of the Jaragua National Park. After hearing the conclusions of the parties, she set the issuance of her sentence for today at 9 AM.

In her reserved judgment, she set different time limits in order to comply with procedures that would allow the tribunal to consider each one of the arguments of the parties in order to dictate the sentence.

The State requested the court to declare the property transfers, property operations, the demarcations, subdivisions, adaptations, and any other operation or transaction from 1990 until now be declared null and with no legal standing. This request covers the parcels of land that were obtained through illegal actions to the prejudice of the national Park and the Bay of Eagles.

They asked the magistrate to order the immediate removal or expulsion of any person individual or company who is occupying parcel 215 - A in cadastral district number 3 of the municipality of Enriquillo, in the province of Barahona without legal standing.

In addition the State wants the judge to order the regional director of Surveying to cancel each and every one of the plans of these parcels.

These conclusions were presented by Fermín Casilla Minaya, Laura Acosta Lora, Gustavo BiaggiPumarol, Manuel Cáceres Genao, Blas Minaya, Samuel Ramia, Sofani Nicolás David, Germán Ramírez and. Ángel Contreras.

They asked the court to order the Registrar of Deeds of Barahona to cancel all the evidence of sales that were noted on deed Number 28 issued in favor of private individuals and parcel 215-A.
