The Senator put before the SCJ a request for lifting the opposition

The Attorney General embargos apartments, villas, houses and factories belonging to Felix Bautista
SANTO DOMINGO. The Attorney General of the Republic placed an embargo on numerous property assets of the Imobiliaria Rofi, S R L, a company of which Senator Felix Bautista is a shareholder, and third-party purchasers.

The oppositions filed at the request of state's attorney Francisco Dominguez Brito, included apartments, villas in Casa de Campo, houses, lots and asphalt plants as part of an investigation being undertaken by the Specialized Prosecutor for the Persecution of Administrative Corruption (PEPCA) against the legislator.

The embargoes themselves took place in the National District, the province of Santo Domingo, San Pedro de Macoris, Santiago and Nagua. Among the assets are 40 buildings of eight apartments each, a 16 story tower and another of 14 stories.

All told, the list surpasses 100 property assets in different parts of the country. Trying to recover the assets, Bautista, the Senator for San Juan and Secretary of Organization of the Dominican Liberation Party (PLD), filed a request for the removal of opposition before the Supreme Court of Justice (SJC).

In a file deposited by his lawyer, Juan Antonio Delgado, asks the SCJ to certify that the plaintiff empowers the Chief Justice so that he appoints under the a statutes established in article 379 of the Penal Process Code, a judge of Special Instruction.

The purpose is is to hear, as a judge of control or of resolution of petitions, regarding the request to remove the oppositions filed "in an illegal or unconstitutional manner against numerous real estate properties of the Inmobiliaria Rofi SRL company; in which Senator Felix Bautista is a shareholder, as well as third-party purchasers." By means of sentence Number 71 - 2014, the Chief Justice of the SCJ, Mariano German Mejia, appointed Frank Soto Sanchez, as Special Instruction Judge in order to decide upon the request.

In March of this year, the person who is also Secretary of Organization of the PLD required through a notarized request that the Attorney General should present the evidence which makes up the case file on which an investigation was being carried out involving public penal action against his person.

The legislator and his lawyer showed their surprise at the citation to appear for an interrogation, arguing that these are the same incidence related with that investigation which was carried out by the Justice Department, and which ended with this sentence 03093, issued by the director of the department been known as DPCA,, Hotoniel Bonilla, on 13 August 2012.

Today in the SCJ


Today, the Plenary of the SCJ is getting ready to hear, at 9:00 a.m., a request that seeks to revoke the definitive dismissal of the investigation of an accusation for alleged bribery by the legislator to the Haitian president, Michel Martelly, for the alleged award of projects to construction companies of his property. At the same time the Second Chamber of the SCJ has a decision pending on an appeal filed by Bautista, against the decision of the judge of the Supreme Court, Victor José Castellanos, will revoked the provisional dismissal of one of the investigations for alleged acts of corruption.

The actions

The Attorney General of the Republic has carried out actions to have dismissals which favored the PLD legislator revoked. To such ends, he has filed petitions in the Supreme Court of Justice asking that the final decisions carried out by the then National Director for the Persecution of Administrative Corruption (DPCA), Hotoniel Bonilla, on 13 August 2012 be revoked or annulled. The cases are pending in the SCJ.
