Chamber of Deputies yesterday sent Penal Code to Executive Power

Despite criticisms regarding legislative and constitutional procedures

SD. In the midst of legislative and constitutional questioning, the Chamber of Deputies sent yesterday to the Executive Power the Law of the Penal Code of the Dominican Republic so that it can be promulgated.

In a letter sent to President Danilo Medina by the president of the lower chamber, Abel Martinez, he said that the observations Medina made to articles 107, 108, 109 and 110 of the above Law were submitted to the consideration of the Plenary with a text (alternative) written by himself.

This procedure, "in accordance to your motivation (the President's) to make the exceptional suppositions more explicit regarding what should prevail in the fundamental law to the life of the woman who is pregnant, or the right with respect to her human dignity and to her physical and moral integrity, and taking care to protect at the same time the judicial security of those who have the obligation to provide medical assistance in the case of the events indicated." Martinez says to Medina that it is an honor for him to send him according to the constitutional requirements this legislative proposal with the observations by the Executive Power approved by the Chamber of Deputies.

The information was released through the official Twitter accounts of the Chamber of Deputies and its president:@DiputadosRD and @abelmartinezD.

The document was received in the office of the Judicial Consultant to the Executive Power, at 2:21 in the afternoon yesterday.

They were sectors that have expressed themselves to be against or in favor of the decision of the plenary of the deputies. Senators, deputies and jurists believe that the legislative initiative approved should have been sent to the Senate in order to comply with what is established in article 102 of the Constitution.

This was the consideration of the constitutional lawyer Eduardo Jorge Prats.

At the same time his colleague Candido Simon had criticized that this Law was approved with a simple majority vote.

CD Commission will work on special Law

The Gender Equality Commission of the Chamber of Deputies met yesterday in order to evaluate the process through which the observations by the Executive Power to the law which modifies the Penal Code were chosen, and determine their contributions for the preparation of a Special Law to deal with abortion in the cases of rape, incest and congenital deformities. The chairwoman of this commission, Magda Rodriguez, said that they have evaluated the different positions regarding the legislative procedure. She also said that they decided to create a proposal in order to deal with these exceptions.

Finjus questions procedure utilized in Chamber of Deputies

The Institutionalism and Justice Foundation (Finjus) expressed its worry regarding the manner in which the observations to the Penal Code were approved, as well as the decision by the Chamber of Deputies to send the text that was approved directly to the Executive Power, without passing through the Senate.

Servio Tulio Castaños Guzmán, the executive vice president of the entity, said that in the procedure carried out in the Lower Chamber, a series of irregularities contrary to the Regulations of this body occurred, which affect its institutionalism and transparency.

"Even more, the abruptness of the presentation and acceptance of the proposal by the President of the chamber is worrisome because it was approved without the text in question being submitted to a debate, as is well ordered in the dispositions of the Regulations." It is noteworthy that they heard in a single vote both the approval of the observations as well as the proposal of the writing of the observed articles, when both constitute two different procedures.
