The District Attorney says that the investigations corroborated the actions.

SANTO DOMINGO. The Superintendency of Banks recommended to the District Attorney of the National District the inclusion as defendants of 13 persons on charges of crimes inside the Banco Peravia, where they allegedly granted 1292 fraudulent loans, which represented an amount of RD$1.4 billion.

He said that those resources are equal to 75.3% of the total loan portfolio of the entity, which on the date of notification of the dissolution amounted to RD$1.9 billion.

In a report sent to District Attorney Yeni Berenice Reynoso, the Superintendency of Banks stated that the DA can include as defendants, including but not limited to, Nelson Serret Sugrañez, Carlos Alberto Serret Sugrañez, Jorge Serret Sugrañez, José Luis Santoro, Gabriel Jiménez Aray, Luis Manuel Peña and Daniel Morales Santoro.

Likewise, Nelson Cabral Veras, Rolando Cabral Veras, Yesenia Serret, Jocelyn Leal, the Certified Public Accountant Génova Isabel Torres, who supposedly provided the accounting reports for more than 90% of the loans and the notary public Moisés Barinas Villalona, who presumably legalized the fraudulent contracts.

The report by the Superintendency recommends including any person who might result responsible, once the District Attorney concludes her investigations. "The investigations carried out by the Justice Department, so far show that effectively, the regulating agency was correct, since from the interrogations, searches, seizure of properties and other efforts by investigators carried out by the Justice Department, it has been found that the defendants are absolutely responsible for the present process," underlines the District Attorney.

She says that although José Luis Santoro was a member of the Executive Committee of the bank, in practice he was a co-president together with Gabriel Jimenez Aray, as is shown by the alleged maneuvers made by the entity, the orders that he gave, and even shared the same floor.

"Another way of the irregular operations consisted in granting in a single day several credit cards with high limits in favor persons that did not fit the profile for being benefited with such elevated amounts."

She adds that the case files of those clients do not include the signed applications, the authorization contracts for the issuance of credit cards or the receipts. She says that they only have an authorization in an email by José Luis Santoro and Gabriel Jimenez Aray.

It was discovered that on the same day of the emission of a credit card, cash withdrawals in ATMs for amounts equal to 50% of the limits, and within five and seven days after their expedition, they consumed the total of the approved credit, without making any payments in favor of the bank. She established that within the years 2012 to 2014, Santoro carried out direct transfers for an amount of US$796,768 which he made through his account.
