The mayor of Las Terrenas is indicted for fraud

SANTO DOMINGO. The Specialized Prosecutor for the Persecution of Administrative Corruption (PEPCA), presented a formal indictment and requested the opening of a trial against the Mayor of the municipality of Las Terrenas, José Mercedes Martinez Emeterio, his wife and the former treasurer of the city government. The indictments accuse the defendants of alleged misappropriation of funds for more than RD $20 million.

The former treasurer Willis Alberto Vilorio Sarante and the mayor's wife Basilia Castillo Espinal were accused by the indictment.

Laura Guerrero Pelletier, the PEPCA director, said that the accused allegedly committed the crimes of collusion of officials, lying, fraud, and issues incompatible with the position, criminal association and abuse of trust.

The accusation was presented before the Penal Chamber of the Court of Appeals of San Francisco de Macoris. PEPCA sustains that in the investigative process they found out that with their criminal acts the officials of the city government incurred in irregularities in the handling of public funds for more than RD$20 million. They argue that during the period 2006 - 2014, the administration of Mayor José Mercedes Martinez Emeterio, as revealed by an audit carried out by the Chamber of Accounts of the Republic and the Justice Department, they were able to prove among other things, that there occurred it regularly such as that in which as the Mayor he carried out a regular purchases at the FERRE-MAS hardware store, and in formal company belonging to his wife Basilia Castillo Espinal, with whom he had married under the regimen of communal property in 2006. The accusation establishes that in 2013, he issued 11 checks in favor of Basilia Castillo and or FERRE-MAS for a value of RD$1,025,696.32.

In addition, the accusation says that they carried out the payment of the payroll without it being signed or stamped. Equally the Ayuntamiento, by a decision of the Mayor, carried out 73% of the projects analyzed between 1 January and 31 December 2010, without any contract between the parties, "this is to say without any legal document that allows verification of amounts, compliance of clauses, requirements and penalties for failure to comply."

The indictment says that they were able to establish also, that the Mayor granted projects without having carried out a public tender, "in a clear violation of Law Num. 340 - 06 on Purchases and Contracts of Goods and Services of the State, proving that this was to favor certain companies." Likewise, the prosecutor said that he authorize payment through petty cash funds in projects without any documents to support the existence of these projects.
