Reform commission will debate the aspects of the law today


SD. The debate on the legislative proposal which convenes the general assembly in order to modify the Constitution of the Republic will continue today at 4:00 p.m. in the Special Commission Hall in of the Senate.


The discussion will center on whether the proposal is ordinary or organic(common law or constitutional law). The Senator for Azua and member of the special commission, Rafael Calderon, argued that "the Commission has been hearing and reading the communications which they have received and the opinions of some colleagues," so that he does not know if the proposal will be approved today. However he said that it is his understanding that the legislative proposal is common law.


For his part, the Senator from Maria Trinidad Sanchez and a commissioner, Aristides Victoria Yeb, said that whether the law is constitutional or common law is still under debate. But it was his understanding, "it is constitutional, because in 2010, for the first time they establish the constitutional character of a series of laws, and it is established in article 112 of the Constitution and by the procedures for the reform of the Law of Laws cannot be by simple majority."

He warned that if the reform is passed in an ordinary manner the process will be taken before the Constitutional Tribunal (TC). "If it is approved in the ordinary fashion, at the end in the Assembly it is not going to pass. This is going to end up in the Constitutional Tribunal, unfortunately," he said.

Felix Vasquez, of the PRSC, said that "the law is not constitutional," but he understands that "the proposal must be studied, there are things that one cannot foretell, because it can end up poorly."

The special commission composed of nine members has a membership which seems in its majority to favor the proposal. These are Reinaldo Pared Perez, who together with Euclides Sanchez, Felix Nova and Rafael Calderon support the proposal, while Amable Aristy Castro and Felix Vasquez indicate the same tendency. This does not seem to be the position of the other members of the commission, Aristides Victoria Yeb, Julio Cesar Valentin and Adriano Sanchez Roa.

Proposal

The legislative proposal declares the need to modify the Constitution in its article 124 in order to permit the consecutive re-nomination of President Danilo Medina, and Institute the system of one consecutive reelection and never more. It includes a transitional paragraph which would impede the president from opting for a third term, if he tries for reelection for the 2016 - 2020 period.
