Court awards two apartments of the mayor of the National District to Impacto Urbano

The city government put the case in the hands of the Judicial Consultant

SANTO DOMINGO. The judge of the First Chamber of the Civil and Commercial Court of First Instance of the National District awarded the Impacto Urbano company two apartment that belong to the mayor of the capital, Roberto Salcedo, during an auction that was held yesterday.

The magistrate Kandy Marcial Pascual took the decision after opening the process and the non-appearance of any other offers.

Diario Libre tried to communicate with the capital's mayor in order to learn his reaction, but it was not possible. Nevertheless, a source at the Mayor's Office said that the case is in the hands of the city's Judicial Consultant, because it is an institutional case and they will proceed in the manner required by the case.

The apartments awarded for a value of RD$31 million, are located on the Pedro Henriquez Ureña Avenue, Torre Romanza, apartments 1-B and 3-B.

"The price offered on the first bid is RD$31,375,224.12, plus the fees which are RD$274,200."

The decision came at 11:13 a.m. The hearing, which was set for 9:00 a.m., had to do with litigation between the company and the mayor, which came from a sentence of the Civil and Commercial Chamber of the Appeals Court of the province of Santo Domingo.

This decision from 3 December 2005 imposes the payment of penalty of RD$10,000 per day that the contractual obligations of Impacto Urbano are ignored and the billboards of the Dominican-Argentinean company are respected. Through their lawyers, Rolando de la Cruz Bello, Rafaela Espaillat Llinas and Jorge Elizardo Matos, the company notified the sale at public auction of the properties. Likewise, they released a public notification of the auction.

The properties affected by the court's decision are apartments 1-B and 3-B of the Torre Romanza Condominium, each one with an area of 360 m2, located on Pedro Henriquez Ureña Avenue, near the corner of Alma Mater. The Impacto Urbano enterprise, which is headed by the Argentine citizen Pedro Miguel Sheppard, was established in the city of Santo Domingo in 1998, through authorization granted by the administration and the City Council of the city government of the National District during the administration of Johnny Ventura.

The company says that five judges of the Appeals Court of the National District established in a definite and irrevocable manner the contractual relation which protects the company.

In March 2009, the Justice of the Peace for municipal affairs of the National District dismissed charges against the executives of the publicity company who had been sued by the city for allegedly operating illegally and for which they sued the company for RD$38 million and requested 8 months of prison for each of the executives.
