Chief Justice of Constitutional Tribunal proposes strategy for Justice sector
Ray Guevara expressed his worry over the at-times uncertain panorama of the justice system

SANTO DOMINGO. The chief justice of the Constitutional Tribunal (TC), Milton Ray Guevara, suggested the creation of a National Strategic Plan for the justice sector, as a way to respond to the needs and the expectations of the Dominican society.
He argued that in the plan the Supreme Court of Justice, the Justice Department, the Public Defender, the Superior Electoral Tribunal, the TC, the College of Lawyers and the legal associations as well as the law schools, should establish the guidelines and governing principles for the judicial processes for the years to come. These should contain the models of how justice should function and which the society and the Dominican people deserve.
The magistrate estimated that this plan should contain at least five strategic objectives.
He cited the promotion of the optimum access to justice; guarantee the transparency, efficiency and quality of the provision of justice services; motivate the permanent improvement and modernization of the justice system; institutionalize the system of meritocracy; and fight against impunity, contributing to public safety.
Ray Guevara assured reporters that the National Development Strategy, the instrument that defines the value of planning, contains general indicators on this subject which are very valuable.
"The moment has arrived for the Justice Branch, inserted in the process of dealing out justice, takes on the challenges that go with their responsibility and contribute in an efficient manner to the achievement of the success of the necessary public policies, in order to achieve a Dominican society that is fairer and more humane," he said during a speech at the release of the Constitutional Bulletin 2013 at the Pontifical Catholic University Madre y Maestra in Santiago.
He expressed his conviction that the strategy will receive both national and international backing, because it will be a positive and well inspired contribution in the search for greater levels of protections and the preservation of the fundamental rights, judicial efficiency, judicial and citizen security.

He said that he felt that the citizen is deeply worried over the issue of crime and organized crime.
"The generalized perception is that the regulations of the Penal Process Code are an incentive to the commission of crime and are independent of its positive aspects."
He said that in the practice, many homes and families are today lacerated by a double pain; the physical pain or the deterioration of the faculties of a loved one, and the lack of an adequate sanction, "and even by a kind of impunity that gives an incentive to recidivism."

He said that in the environment of property jurisdiction, after the reform launched in the system, there have been advances. Nonetheless, he said that he feels that at the present time for many property owners or alleged owners, the situation is a bit less than chaotic, in spite of the millions invested with national and foreign funds. The development and application of new technologies have not been able to dissipate the impression that the investments are not safe.
