The Superior Administrative Tribunal decides today on request regarding coal-fired generators

The Superior Administrative Tribunal (TSA) is ready today, at 9:00 a.m., to hand down its decision on a request which seeks to rescind the suspension of the international public tender process for the construction of two coal-fired generation plants. The presiding judge of the tribunal which has national jurisdiction, Delfina de León Salazar, convened the parties so that they can listen to the verdict.

The Tender Committee of the Dominican Corporation of State - owned Electricity Enterprises and Odebrecht-Tecnimont requested the removal of the injunction. In court, the CDEEE and Odebrecht presented the letter in which the Gezhouba company does not support the legal action against the international tender.

The judge accepted a request for an injunction filed by the Gezhouba Group Company Limited, where the Impe Consortium voluntarily intervened. The magistrate suggested that after studying the case, she has been able to confirm that in the process of the tender carried out by the CDEEE, with respect to the sentence regarding the project for the construction of the coal-fired electricity generation plants,an inconsistency was created regarding the approved value by the General Budget Law of the state.

She specifies that in this law, in article 52 it provides for a maximum amount of US $1.5 billion for this project. Likewise, she said that the project has been awarded for an amount of US $2.4 million, without showing in the file of documentation that they have complied with the single paragraph of article 234 of the Constitution.
