Judge rejects motions in Felix Bautista case
SANTO DOMINGO. The judge of Special Instruction of the Supreme Court of Justice, Alejandro Moscoso Segarra, rejected 3 motions which sought to annul the process against Senator Felix Bautista and reduce the number of representatives of the Justice Department in the hearing of the preliminary audience against the legislator and another 6 persons accused of alleged corruption and money laundering.

At the reopening of the preliminary hearing, at 3:00 p.m., the magistrate gave his decision rejecting a motion by Manuel Ulises Bonelly Vega and Marino Feliz Rodriguez, defense lawyers of the defendant Soraima Antonia Abreu Martinez. The jurist suggested that the entire investigation be annulled and that the evidence collected in violation of article 95.1 of the Penal Process Code and which are the result of these consequences, including the accusation presented against her because they had been carried out in violation of the regulation.

This petition was joined by the legislator's defense, which is composed of lawyers Pedro Balbuena, and Marino Feliz, as well as the legal representatives Ramon Emilio Nuñez, José Elías Hernández García; Francisco Álvarez Aquino and Joan Manuel Alcántara, who represent Gricel Aracelis Soler Pimentel; Abel Rodríguez del Orbe y Manuel Pérez, who represent Bienvenido Apolinar Bretón Mejía; Ybo René Sánchez y José Luis González, who represent Bolívar Ventura; and Jorge Lora Castillo and Carlos Olivares, who represent Carlos Manuel Ozoria and José Elías Hernández García; Francisco Álvarez Aquino and Joan Manuel Alcántara, who represent Gricel Aracelis Soler Pimentel; Abel Rodríguez del Orbe and Manuel Pérez, who represent Bienvenido Apolinar Bretón Mejía; Ybo René Sánchez and José Luis González, who represent Bolívar Ventura; and Jorge Lora Castillo and Carlos Olivares, who represent Carlos Manuel Ozoria.

The representatives of the Justice Department, Carlos Castillo, Laura Guerriero, Wilson Camacho, Milciades Guzmán, Narciso Escaño, Wagner Cubilete and Taipei Joa, requested the rejection of the motion, because it was without foundation and lacked legal substance.

Another motion rejected sought for the judge to limit to 3 the number of representatives of the Attorney General at the preliminary hearing, because it violated the principle of equality. The magistrate argued that reducing the number of prosecutors would represent a disadvantage in relation to the lawyers of the defense.

A 3rd motion sought to declare the annulment of the investigations and the accusation, with respect to Abreu Martinez, after saying that the Constitution of the regulations were violated relating to the warrants carried by the officials without the authority to do this. The other defendants joined in these conclusions. The judge decided to reject this request together with the basis.
