Law on Parties would regulate funds, quotas and publicity
SD. If they achieve a consensus during the discussions, today the draft of the legislative proposal for the Law of Parties and Political Groups will be ready. This law contemplates limits regarding the sources of income of the parties, as well as the obligation to fulfill a quota of elective positions in favor of women and would impose regulations on publicity.

The initiative was prepared based on proposals debated by the different parties and the Central Electoral Board (JCE), and would establish that they would only consider as sources of income for the parties, acts of economic cooperation, assistance or contributions carried out by private national individuals and corporations.

"Lawful income of the parties is considered to be the donations or contributions that come from these acts; and the direct or indirect intervention of the state, of any of its departments, dependencies or autonomous or decentralized agencies or of companies that fall within the application of the Law of Foreign Investment, the ayuntamientos or entities that depend on them, or of foreign governments in the support of the parties or the financing of their campaigns will be unlawful," cites the rough draft of the proposal.

In addition, it prohibits the parties, their leaders, membership or relations, to receive tax exemptions, donations or presents from any state power or city government, to be used in campaigning.

If the proposal is approved, it would facilitate the JCE in annul, seize and impose an injunction with the help of law enforcement agencies for any improper use of the resources and media of the State.

Regarding the quota for elective positions, the initiative would establish that at all times 33% of the elective positions will be for women, and must be respected, since such a measure will be obligatory. "The JCE will not accept lists of candidates that do not include the 33% quota for women, on all national ballots," they indicate.

They explain in detail that within a 72 hour period, the JCE should evaluate the proposals made by the groups and parties in order to establish their compliance with the quota and will proceed to reject those list that do not fulfill the requirements.

Regarding publicity and the media, the law intends to Institute that all political parties should enjoy equal possibility for the use of the media during the election period.

It specifies that the media administered by the state should balance the announcements and promotions between each one of the political parties and groups. In the case of coalitions, these will not have a greater number of announcements than those assigned to a single party which runs independently.

It will be up to the JCE, in the case of violations of the law, to withdraw the ads and impose fines of up to 50 times the value of each ad.

For today at 11:00 a.m., representatives of the parties, and the heads of the JCE, the Chamber of Deputies and the Senate will meet at the PUC MM.
