Cases of hired killers revive debates on "complicity" of the mastermind
Jurists differ on having the same sentences for he who pays and the executioner

The constant cases of killers-for-hire that have dismayed the country lately, are reviving the debate regarding the stiffening of the sentences for these criminals, above all in relation to those who order and pay for the death of another person, which in the current legislation is judged as an accomplice. This disposition is attacked and defended by different jurists, whether it is to keep it like it is or to make those that order the crime, the same as the perpetrators themselves.
The expert in penal law, Felix Damian Olivares feels that he is among those that think the punishment should be the same. He considers that the figure of the accomplice is a mistaken criteria in the French Code which was inherited by the Country. "The mastermind, in fact, should be penalized with a more severe sentence than the perpetrator, because it is he that requires it and who benefits from the crime."
He recalls that the figure of co-author was not clearly defined in the current legislation and that because of this in the proposal for the modification of the Code, it is established that the perpetrator or the man behind the crime can be sentenced to the maximum. This should be 40 years in place of the 20 years now on the books for an accomplice. "What is urgent now is the modification of the Code."
In the same way, the professor of Criminal Law, Luz Diaz Rodriguez, expressed her point of view, since she feels that this is the time for promoting the approval of the new Code. The lawyer believes that this would have an impact on the person who is the mastermind, and who is now favored with the sentencing guidelines in relation to the perpetrator. However, Rodriguez, the same as Olivares, warns that the change in the punishment in and of itself will not reduce killings-for-hire, but what is certain is that they will serve the time, and she argued for improvement and efficiency in the investigative agencies.
For his part, lawyer Carlos Balcacer insists that without a person who carries it out, the crime does not happen, no matter how much someone wants it to happen, so that he defends a lesser sentence for the mastermind.
Balcacer, who makes a sort of profile of the persons that carry out these killings-for-hire, argues that, from the state more attention should be given to the problems of the young people who have nothing to do in the barrios. He sees the installation of polytechnic institutes in the barrios as something positive.
In the meantime, for the Public Defender, Zoila Martinez, she attributes the existence of these killers to the social decomposition, and a lack of opportunities. She argues for the state to pay attention to this problem.
