Fernandez secures lands for Metro II and Train

DOMINICAN REPUBLIC.- President Leonel Fernandez declared 20 parcels of land in Los Alcarrizos to be public domain and of social interest, and they will be destined for the construction of the rail yards and workshops of the Number Two Line of the Santo Domingo Metro and the Train Station for transferring from the Freight and Passenger Train Santiago-Los Alcarrizos-Port Haina to the Metro Line.
The section of land that will be used for the railroad infrastructure is called a cadastral polygon and defined by the coordinates UTM NAD 83.
The polygon is located to the West of the Duarte Highway and to the South of Los Alcarrizos, and belongs to Cadastral District Number 12.
The parcels that were appropriated are numbers 5, 7, 7-B, 8-A-I, 8-A-1-B-1, B-132, 8-B-C-005-12647 and 48; 8-B-2, B-3-c, B-3-C, B-3-C-1, C-2, C-3, C-4, C-5; and 49 and 50.
The Decree 691-09 says that the request for a declaration of public utility was drawn up for the Executive Branch by the Office for the Reorganization of Ground Transportation (OPRET) on 2 September 2008.
The disposition establishes that in case a friendly agreement with the property owners of the lands affected by the decree is not reached, the administrator general of State Assets will carry out all of the acts, procedures, and resources, both ordinary as well as extraordinary, according to the laws, in order to obtain the expropriation of the land.
"The urgency for the Dominican state to obtain possession of the lots aforementioned, in order to allow the immediate beginning of the works indicated, after fulfilling the legal requirements required by law is hereby declared," says the decree.
The decree assigns that possession by the state will be carried out by the State Lawyer because this is land that is registered, and when necessary, the State Lawyer can secure the application of Law 486 of 10 November 1964 that added Paragraph II to Article 13 of the Law 344 of 29 July 1943.
The President also exercised the right of eminent domain and declared 299,978 square meters of terrain to be of public necessity and social interest. The land is part of Parcel 171 of the Cadastral District 30 of the province of Santo Domingo.
These lands will be used for the construction of a housing complex to locate families affected by the construction of Metro Line II and the Freight and Passenger Train that will go from Santiago, through Los Alcarrizos, to the Port of Haina.
The properties are located in the Mojarra section on the highway between Guerra and Bayaguana and are covered by the Land Registry Certificate 49528.
The land was donated by the State Sugar Council to the Pro-Industrial San Luis Industrial Park Patronage, and the Foundation for Industrial Improvement of Santo Domingo Province (FUFI-SADO).
Decree 721-08 says that according to the donation contract of 11 February 2002, the Ozama Sugar Mill transferred this portion of land to the FUFISADO, and that the State Sugar Board (CEA) has provided follow up on the use of the lands and declares that up to now the land has not been used for the ends for which it was donated.
For their part, the National Council of Free Zones has cancelled the permit to operate an industrial park by Resolution ADM. No. 01-08-CP, 17 June 2008, "for not having begun their operations in compliance with the Law 8-90 and the regulations thereof."
