Granting of nationality by JCE "without compliance to requirements" to be investigated
Fadul sends letter to Rosario in which he requests his collaboration

SANTO DOMINGO. The Ministry of Interior and Police requested in a letter to the president of the Central Electoral Board (JCE) their collaboration in order to investigate the cases in which members of that institution have granted Dominican nationality to spouses and children of naturalized persons, under the same conditions as to the children and spouses of Dominicans.
In the letter dated 29 May 2015, the Minister of Interior and Police, José Ramon Fadul Fadul says that this type of granting of the nationality is being done without complying with the requisites "since they should be processed by the Ministry of Interior which is the only entity with the authority to formalize and later grant nationality to foreigners."
The letter, according to what Fadul says, is sent given "reports from national and foreign citizens that the JCE is processing the transcription of certificates of civil status for spouses and children of naturalized citizens, accrediting them with Dominican nationality, without complying with the requisites indicated by Law Num. 1683 of April 1948, regarding naturalization."
Fadul points out to Roberto Rosario, the president of the JCE, that the public servants of that institution are granting that status are carrying out an "erroneous interpretation" of resolutions 9/95 and 5/2001 by the plenary of the JCE on the occasion of an inter-institutional agreement signed with the Ministry of Foreign Relations, through which the Board "takes on issues of identity and acts of Civil Status and is the overseas representation of the state with its citizens for the accreditation of the nationality of the children of Dominicans born overseas, to which Interior is not opposed and has adhered to the agreement."
He says that the resolutions referred to the parameters for the transcription of acts that "in the case of resolution Num. 9/95 deal with the requisites for the transcription of acts of the Civil State of foreigners, which is said to be applicable for the cases of children of Dominicans born overseas, such as indicated by resolution Num. 5/2001 and that in an incorrect manner is being applied to the children and spouses of naturalized citizens without complying with what is stipulated in the law on naturalization, receiving in this way the same treatment which is conferred on the children of Dominicans born overseas."
The document which is numbered 007609 and signed by José Ramon Fadul Fadul was obtained by the Diario Libre and demands from the JCE "all possible collaboration in order to establish an exhaustive investigation of the case indicated and take the measures that are necessary in order to avoid foreign citizens continuing to violate the procedures established by the law."
At the same time he notes that Interior will continue to provide follow-up for the cases in order to adopt the corresponding precautions as the institution charged with supervising the immigration and naturalization policies according to the established judicial norms.
