Leavy Nin Batista negotiated surrender for three months
She will be taken before a judge of Instruction today

SANTO DOMINGO. The fugitive, Leavy Nin Batista, the wife and a person tied to the network of drug trafficker Jose David Figueroa Agosto, was negotiating her surrender with Dominican authorities for more than three months. This was reported yesterday by the District Attorney for the National District Alejandro Moscoso Segarra, who said that at one time the authorities even met with the accused in order to arrange her surrender.
The District Attorney announced that today Nin Batista would appear before the Second Court of Instruction for a hearing on coercive measures, after a preliminary hearing she must face on charges of money laundering, criminal association, falsification of public documents and the use of false documents that have been filed against her. Nin Batista arrived in the country on Saturday afternoon from Madrid, Spain, where she was found by the authorities that she had avoided since September 2009 when it was thought that she left the country.
For her apprehension, the accused had approached the authorities through the Dominican consulate in Spain, and in spite of the fact that the District Attorney says that they recommended that she surrender because it was better than being captured by the international authorities, the wife of Figueroa Agosto laid down her own conditions. "She was given guarantees that she would be moved without mistreatment, that she would travel with her daughter, who is a minor. She was also guaranteed that her daughter, one some of the processes here were over, would be taken out of the country and taken to her father's country (Figueroa Agosto is Puerto Rican)", reported the District Attorney, who did not discard reaching another type of negotiation during a second phase. He made it clear, nevertheless, that during the time that the negotiations were going on, the fugitive was under observation by the authorities.
Felix Portes, the lawyer for Nin Batista, as well as for the mistress of Figueroa Agosto, Sobeida Feliz Morel, also denied any other type of negotiations until the moment that it would favor his clients or any of the other of the persons that are under indictment for belonging to the network. He indicated that although the case file against Nin Batista might be merged with that of the other defendants that will stand trial, this case could also be tried separately so as not to stop the process in the courts.
A part from Feliz Morel, the alleged members of the money laundering network are Eddy Brito Martinez, the former husband of Feliz Morel; Sammy Dauhajre, Ricardo Ivanovich Smester, Josn Jose Fernandez Ibarra, Mary Pelaez, Dolphy Pelaez and Madeline Bernal Peña.

Moscoso Segarra reported that Nin Batista's daughter, whose name is omitted because she is a minor, is under the care of a family member, in a place that was not identified for security reasons.
