SANTO DOMINGO.- The judge of the Second Court of Instruction, Claribel Nivar Arias, sent Leavy Nin Batista to protective custody in the Najayo Prison for three months. Nin Bastista is the wife of the convicted Drug trafficker Jose David Figueroa Agosto and she is tied to the money laundering network that the authorities attribute to the Puerto Rican drug lord.

Nin Batista appeared before the court at 9:00 in the morning yesterday, accompanied by her lawyer, Felix Portes, who tried, without success to get her released on bail.

Portes asked the judge to grant a bail bond and leave the accused free, alleging among other things that she needed to care for her daughter of just 9 years old, as well as the fact that Nin Batista did not represent any flight risk because she had voluntarily surrendered to the authorities. He alleged furthermore that Figueroa Agosto's wife did not leave the country illegally but rather she left normally through the airport, since there were no travel restrictions placed on her.

Nevertheless, the magistrate Nivar Arias rejected the allegations of Nin Batista and her lawyer and accepted those of the District Attorney, represented by the assistant prosecutor Wendy Lora, who asked for remand as a way to guarantee her presence during the process that is underway against her. The deputy prosecutor alleged that the defendant was never available when they tried to locate her to appear before the courts.

The judge also dictated the end of the charges of contempt of court that had been issued against Nin Batista after she left the country in September 2009. The accused returned last Saturday from Spain, where she had carried out a negotiation process with the Dominican authorities over her voluntary surrender during the past three months.

The judge also set 9 May as the date for the preliminary hearing for Nin Batista, in order to answer charges of money laundering, criminal association, falsification of public documents and use of false documents which the prosecutors have filed against her.

Nin Batista, who until yesterday was being held in the jail at the Palace of Justice in Ciudad Nueva, will appear before the magistrate on 18 July for a review of her coercive measures of protective custody.

The accusations against Leavy Nin Batista are part of the charges by the Justice Department against an alleged ring of money laundering that served Figueroa Agosto, jailed in Puerto Rico, and in which Sobeida Feliz Morel, her former husband Eddy Brito Martinez, Sammy Dauhajre, Ricardo Ivanovich Smester, Juan Jose Fernandez Ibarra, Mary Pelaez Dolphy Pelaez and Madelin Bernard Peña also are involved.
