PEPCA asked for remand to custody for Raul Mondesi

The Court of San Cristobal will hold a hearing today

SAN CRISTOBAL. The Penal Chamber of the Court of Appeals of San Cristobal of will hear today, at 9:00 a.m., a request for preventive custody (remand) against Mayor Raul Mondesi, accused by the Specialized Prosecutor for the Persecution of Administrative Corruption (PEPCA) of alleged misappropriation of more than RD$200 million.

In the indictment, they are asking the judge to decree the opening of a trial and the imposition of coercive measures for serious incidents of corruption.

Likewise, they request the judge to set a RD$1 million cash bond, strict and travel restrictions and periodic presentation at the courts for Bienvenido Araujo Japa (the Secretary-General); Pedro Cordero Valverde, the Controller; Antonio De Jesus Ferreira Guzman, the municipal Treasurer, and Eduard Vianelo Guerriero Pontier an official of the mayor's office.

The Justice Department accuses Mondesi and the others of having handled funds in a discretionary manner without complying with procedures; preparing the financial statements without technical criteria; retaining the taxes collected that were not sent to the appropriate agencies; and that they did not minimally comply with the budget.

PEPCA, a dependency of the Attorney General of the Republic, notes that they were able to establish that the accused created bogus documents and made use of false documents in order to arrange service contracts, charged to the mayor's funding, in some cases in relation to the collection of garbage.

They established that the taxes were collected without forwarding them to the Directorate General of Internal Taxes (DGII); they owed money to the Social Security Treasury; there was an absence of the 1 per 1000 owed to the College of Engineers, Architects and Surveyors (CODIA); they retained money from contracts for projects and did not pay the 1% required by Law Num. 6 - 86 regarding the Pension Fund of the Workers in the Area of Construction and all the Related Areas (FOPETCONS), which were retained in contracts for projects.

They are accused of carrying out monthly, consecutive payments to wives, children, fathers in law, and various related persons, as well as friends and relatives of the principle authorities, the majority of whom did not attend or provide service to the government of the city Council.

The accusation establishes also the sale of transportation equipment (scrap) in violation of the laws and the regulations.

They indicate that the defendants used names of false persons in order to write contracts and cash checks with false endorsements.

Intervention

Last January, the authorities of Public Health, the Environment and the Dominican Municipal League, took over the control of the handling of the refuse in the province of San Cristobal, which was declared to be in a state of emergency due to the improper handling of the garbage. The action originated a personal confrontation between Mondesi and the Minister of the Environment, Bautista Rojas Gomez, over the control and handling of the garbage dump. A plan of environmental rescue was prepared in that province.
